Psilocybin Laws in New Mexico
New Mexico has passed legislation creating a framework for regulated psilocybin therapy and is in the implementation phase. New Mexico is expected to become the third state with a licensed therapeutic psilocybin program, following Oregon and Colorado.
Current Legal Status
Active Legislation — Program Launch Expected 2026
The New Mexico Psilocybin Services Act passed the legislature in early 2026 and was signed by the Governor. The New Mexico Regulation and Licensing Department is developing rules and issuing facilitator and service center licenses. The first licensed facilities are expected to open by late 2026.



Key Legislation
HB 327 (2026) — the New Mexico Psilocybin Services Act — passed both chambers of the New Mexico Legislature and was signed into law. The act authorizes licensed psilocybin service centers and facilitators, modeled closely on Oregon's Measure 109 framework. Personal possession outside licensed settings remains illegal.
Therapeutic Programs
New Mexico's program is in the licensing and rulemaking phase as of April 2026. The Regulation and Licensing Department is accepting facilitator training program applications. **Client access begins December 2026.** New Mexico has also allocated funding for a veteran access scholarship program within the new framework.

University of New Mexico Health Sciences Center has participated in psychedelic research. Check ClinicalTrials.gov for Albuquerque and Santa Fe area enrolling psilocybin studies.
