New Mexico passed SB 219 in 2024 creating a psilocybin services program. It's now 2025 and I'm trying to find out what the current status is — has rulemaking started? Are any service centers licensed yet? When can New Mexico residents realistically expect to access legal psilocybin services?

The New Mexico Department of Health is running rulemaking through 2025. The enabling legislation passed in April 2024. Based on the Oregon and Colorado timelines (both took 2+ years from passage to first licensed centers), the realistic expectation for first NM service center licenses is late 2026 at earliest. The department is currently accepting public comment on draft rules and forming an advisory board. No service centers are licensed or operating yet.

Key differences from Oregon/Colorado: New Mexico's law includes a supervised consumption model without a required 'preparation session' before the service session — this may make the process more accessible and less expensive if it survives rulemaking. The law also doesn't restrict who can facilitate to licensed mental health professionals, which is a point of ongoing debate during rulemaking.

For NM residents who want access now: Oregon service centers are the only legal in-state US option. Several Oregon centers (East Fork Wellness in Ashland, Cascade Integration in Bend) specifically market to out-of-state visitors and have experience working with people traveling from other states.
